The U.S. Department of State has re-published its List of Restricted Entities and Subentities Associated With Cuba, commonly referred to as the "Cuba Restricted List." This list identifies entities and subentities linked to the Cuban military, intelligence, or security services with which direct financial transactions are generally prohibited under the Cuban Assets Control Regulations (CACR).
This action follows a series of policy changes beginning in 2017 when National Security Presidential Memorandum 5 (NSPM-5) was signed by the President. NSPM-5 directed amendments to both the CACR and the Export Administration Regulations (EAR), resulting in prohibitions on certain financial transactions and export applications related to entities on this list.
Initially rescinded on January 16, 2025, after National Security Memorandum 29 (NSM-29) revoked NSPM-5, the Cuba Restricted List was reinstated following an Executive Order issued by the President on January 20, 2025. The list now includes one additional subentity not present before its previous rescission.
Michael G. Kozak from the Bureau of Western Hemisphere Affairs confirmed that "the publication of the Cuba Restricted List implements the directive in section 3(a)(i) of NSPM-5."
