In a case concerning anti-dumping duties on frozen fries from Belgium, Germany, and the Netherlands (DS591), the European Union expressed dissatisfaction with Colombia's compliance following an earlier panel report and arbitration award. The EU argues that Colombia recalculated dumping margins using flawed methodologies, leading to inflated margins for EU exporters. Despite consultations in May failing to resolve the issue, Colombia claims its measures comply with WTO obligations and acknowledges some agreement from the EU regarding certain aspects of their calculations. A compliance panel has been established to further assess these issues.
Another dispute involves anti-dumping measures by the EU on imports of fatty acids from Indonesia (DS622). Indonesia contends these measures violate WTO agreements and impair benefits it should receive. Although consultations took place in April without resolution, Indonesia is pushing for a panel to address its concerns. The EU maintains confidence in its compliance with WTO rules but is not ready to agree to a panel's establishment at this time.
A separate matter involves anti-dumping duties imposed by the United States on ripe olives from Spain (DS577). The EU seeks authorization to suspend concessions or obligations toward the US until recommendations are fully implemented. Meanwhile, discussions continue between both parties as they await arbitration outcomes.
The DSB also reviewed a long-standing issue between Hong Kong and China against US origin marking requirements (DS597). This matter was raised for the 13th time by the US amid recent developments concerning free speech and human rights in Hong Kong. Criticism arose from both Hong Kong and China regarding what they perceive as misuse of DSB meeting time for political purposes.
Efforts continue towards reforming the Appellate Body selection process after repeated proposals led by Colombia representing 130 members were met with resistance from the United States. The US emphasizes ongoing talks about reforming dispute settlement systems while opposing restoring previous Appellate Body operations without addressing specific interests.
Members noted progress made in formal dispute settlement reform processes but acknowledged that achieving set objectives by 2024 seems unlikely without considering interim solutions or mini-packages—a notion not universally supported due to preferences for comprehensive reforms across all issues involved.
Ambassador Saqer Abdullah Almoqbel highlighted ongoing technical work related to dispute reforms while expressing support for facilitators working towards positive outcomes during recent discussions among delegations worldwide within various WTO frameworks including heads-of-delegation meetings held recently throughout November 2024.
