EU challenges Colombian duties on frozen fries at WTO

The European Union has initiated compliance proceedings over Colombian duties on frozen fries, alleging that Colombia's methodologies for calculating dumping are flawed and inconsistent with the World Trade Organization's (WTO) Anti-Dumping Agreement. The EU made this request for consultations under Article 21.5 of the Dispute Settlement Understanding (DSU).

This marks the first request for consultations concerning compliance proceedings following an arbitration award issued under Article 25 of the WTO's DSU. The arbitration was sought to appeal a panel report and was conducted under the Multi-Party Interim Appeal Arbitration Arrangement, to which both Colombia and the EU are parties.

Article 21.5 of the DSU addresses disagreements regarding the existence or consistency of measures taken to comply with a WTO ruling. It stipulates that such disagreements should be resolved through WTO dispute settlement procedures, preferably involving the original panel. If a panel is established, it must circulate its report within 90 days from the referral date.
