The U.S. Embassy in Eswatini has outlined the assistance it provides to American citizens who are arrested or detained in the country. According to the embassy, its main responsibility is to protect U.S. citizens overseas.
In cases of arrest, Americans are advised to request contact with the U.S. Embassy. The embassy notes that Eswatini is a party to the Vienna Convention on Consular Relations, which requires authorities to inform detainees of their right to communicate with consular officials.
If someone becomes aware of a U.S. citizen being arrested in Eswatini, they should contact the embassy and provide information such as the individual’s full name, passport number, details about the arrest, location of detention, and any urgent medical needs.
The embassy describes possible challenges faced by detained Americans: “A U.S. citizen arrested or detained abroad might feel confused and afraid. The detainee might be in a new place and may not know the local language, customs, or laws.” It adds that it can help within its authority while following international, domestic, and foreign laws.
The services offered by the embassy include working “to ensure fair and humane treatment,” providing lists of English-speaking local attorneys, contacting family or employers (with written permission), visiting detainees regularly, delivering reading materials or vitamin supplements if needed, requesting adequate medical care from local officials, giving an overview of criminal justice processes in Eswatini, ensuring access to clergy upon request, and assisting families in sending money.
However, there are limits to what consular staff can do: “We cannot get U.S.citizens out of detention. State to a court that anyone is guilty or innocent. Provide legal advice or represent U.S.citizens in court. Serve as official interpreters or translators. Pay legal, medical, or other fees.”
